Terms and Conditions

 

1. Conclusion of the contract

The contract is concluded as soon as a written, telephone or verbal confirmation has been given to us by the guest. The booking is binding after we have given us a written confirmation. And both parties are bound by it. The room rental company is obliged to provide the booked room. The prices agreed by telephone and confirmed in writing are binding. The prices are per person and night, including bed linen, towels and room cleaning (excl. Special agreements). Note: Small business according to § 19 UstG. The total amount is due when the contract is concluded. The room must be paid for in full in cash on the day of arrival at the latest in accordance with Section 535 (2) BGB. We also accept MasterCard, VISA, EC card, Maestro, Bankcard.

 

2. Reservations

The reserved room is available from 3 p.m. on the day of arrival and until 10 a.m. on the day of departure.

 

3. Arrival

Reserved rooms must be occupied by 6:00 p.m. on the day of arrival. If this does not happen, the guest house can use the rooms elsewhere, unless a later arrival time has been expressly agreed. If the guest arrives later or leaves earlier than booked, the entire booked room rate is still to be paid.

 

4. Departure

The booking of a late check-out until 12.00 p.m. is possible for a surcharge of € 10.00 pp. However, this must be reported at the latest upon arrival, in order to e.g. B. to be able to ensure the room cleaning for the following guests accordingly. In the event of a departure not agreed upon after 10 a.m., we charge € 20.00 pp. A departure after 12.00 p.m. is by no means possible, as we have to guarantee the check-in time for newly arriving guests from 3 p.m.

Should a subsequent guest not be able to move into his room after 3 p.m. due to a late departure, the guest responsible bears all costs incurred plus processing costs.

 

5. Complaints

The guest undertakes to adhere to the house rules posted in the house. In the event of a violation, the landlord has the right to terminate the contract immediately without a refund of the price. Smoking in our house is strictly forbidden, if you still smoke in the house, an ozone purification of approx. 150 € will be charged. The rooms are only to be used by the pensioners. Furthermore, pets are not allowed.

 

6. Cancellation

The guest is obliged to notify the landlord of the cancellation in writing in the event of no-show. Cancellation fees at short notice are due. Cancellation up to 24 hours before arrival is free of charge. The fees are 80% within 24 stunden prior to arrival.

 

7. Liability

7.1 Guest liability

The guest is liable for all damage caused by himself, his fellow travelers, employees or third parties that he has unlawfully taken into the building and / or to the room. The same applies to extremely heavy soiling such as stains on bed linen, walls or floors. The guest is obliged to report any damage to the host immediately. The room or apartment will be inspected by the host or the cleaning staff after moving out. The costs incurred or the additional expenditure incurred may be secured by a security deposit or a credit card guarantee.

7.2 Pension liability

  • The pension's no-fault liability according to § 536 BGB is excluded.

  • The guesthouse is liable to the customer for damage to other items brought by the customer in accordance with the statutory provisions §701 ff. BGB. Money, securities and other valuables can be stored in the room safe. The guesthouse provides the room safe, but assumes no liability for it.

  • A bicycle stand is available for guests in the courtyard area. The guesthouse is not liable for any damage or theft of bicycles.

  • In principle, the pension is only liable for financial loss suffered by the customer in the event of willful intent or gross negligence. Deviating from this, the pension is also liable for simple negligence in the event of financial loss, provided that it has culpably violated an essential contractual obligation; in this case the liability for damages is limited to the foreseeable, typically occurring damage.

  • The above limitations of liability apply to all claims for damages regardless of their legal basis.

  • All claims against the pension generally become statute-barred one year from the beginning of the knowledge-dependent regular limitation period of Section 199 (1) BGB. Claims for damages become statute-barred after five years regardless of the knowledge of the circumstances giving rise to the claim and of the debtor. The shortening of the limitation period does not apply to claims based on an intentional or grossly negligent breach of duty by the pension or culpable injury to life, limb or health of the customer.

 

8. Day guests

In order to avoid misunderstandings regarding damage, day guests are strictly forbidden in our houses. Should our guests nevertheless invite day guests to one of our houses, they will be charged to our guest with € 2.50 per person per day.

 

9. Place of jurisdiction

The place of performance and payment as well as the place of jurisdiction is the court responsible for the place of operation of the pension, Obernburg am Main.

 

10. Final provisions

  • Should individual provisions of these general terms and conditions for the accommodation contract and accommodation in the guest house be or become invalid or void, this shall not affect the validity of the remaining provisions. In addition, the statutory provisions apply

  • Changes or additions to the contract and these terms and conditions must be made in writing.

  • German law applies exclusively. The application of the UN sales law and international private law is excluded.

 

Data protection regulation

  • Processing of inquiries (retention period 6 years)

  • Compliance with the Money Laundering Act of 2017 (retention period 5 years)

  • Tax retention obligation 10 years.

In some cases the data can also be used for informative circulars, newsletters, and congratulations on celebrations.

We would like to point out that the personal data collected from you as part of the aforementioned purposes will be collected, processed, used and transmitted in compliance with the EU General Data Protection Regulation (GDPR).

You can revoke the storage of your data at any time in writing with effect for the future.
